The Ministry of Telecom and Mass Communications proposes to introduce accreditation of ICO issuers

The Ministry of Telecom and Mass Communications of Russia submitted for consideration a bill on the accreditation of organizations providing the opportunity to issue digital tokens

At this stage, public discussions are being held regarding the text of the bill, published on the portal of regulatory legal acts of the Russian Federation.


In the bill, a digital token is understood as “a record created using cryptographic (encryption) means in a distributed information system, which certifies that the owner of a digital token has the rights to receive from the person who placed the digital token the initial cost of the token by presenting this token using a distributed information system systems." 


To pass accreditation, an organization must be registered in the Russian Federation, have an authorized capital of at least 100 million rubles, have a license for the development, production and distribution of encryption (cryptographic) tools; must have a special bank account intended for transactions with funds received as a result of the sale of digital tokens.


The accredited organization must approve mandatory rules for issuers of digital tokens, according to which issuers must redeem digital tokens at a nominal price from any bearer of the token on the basis of an irrevocable public offer, issue digital tokens for Russian rubles through non-cash settlement, use funds received from purchasers of digital tokens only for purposes related to maintaining the ability to fulfill the obligation to repurchase digital tokens at a nominal price.


In addition, the rules must specify the procedure for monitoring the execution of these instructions by the organizer. The decision on accreditation will be made within 30 days from the date of receipt of the application. In addition, inspections of such accredited organizations will be carried out every three years.
